Two for One: How Leveraging Small Claims Procedures Can Improve Both Judicial Efficiency and Access to Justice

    Well-designed small claims procedures can help to improve both judicial efficiency and access to justice.  It is also widely acknowledged that small claims systems which facilitate the swift resolution of disputes can have direct and powerful effects on levels of investment and economic activity. However, it is not always apparent what steps technical experts and policymakers need to take to develop or enhance small claims procedures in a way that brings about these benefits.

    In a Note published by the World ¶¹ÄÌÊÓƵAPP in December 2020, e, the authors outlined the key reform steps that need to be taken to develop, enhance and operationalize small claims procedures in client countries, drawing upon examples from different regions. 

    During this interactive session, the speakers presented the Note and the panel discussed how to operationalize the key findings and recommendations. A judge provided insights on Estonia¡¯s small claims procedure with a particular focus on the use of technology.
